GENERAL TERMS OF SALE
ACCEPTANCE
Any order for an item on the MISTER BATTERY site implies that the buyer accepts the following general terms of sale.
The buyer cannot submit an order on the MISTER BATTERY site without stating that they have read and accepted these general terms of sale when preparing the purchase order. Clicking on the "submit" checkbox stating that they are aware of the general terms of sale has the same value as an electronic signature and is equivalent in the contract between buyer and vendor to a hand-written signature.
The order shall be confirmed by e-mail to the address provided by the buyer on the purchase order.
The information entered by the buyer when placing their order on the www.mister-battery.be site means that they are responsible for any errors in the recipient’s delivery details. MISTER BATTERY cannot be held liable for any resulting inability to deliver the item(s) ordered.
PRICE AND AVAILABILITY
Prices are indicated in Euros (€) including all taxes (VAT and Bebat) and are only valid on the date on which the buyer sends the purchase order. The prices indicated do not include delivery charges, which are indicated before the order is submitted. If a submitted order contains one or more errors (price, description, photo, coupon, etc.), MISTER BATTERY reserves the right to cancel and refund it.
For consignments outside of Belgium, any customs duties, local taxes, import duties or State taxes that may be due (declarations and/or payments to the competent authorities and bodies in the buyer’s country) are payable by and the exclusive responsibility of the buyer importing the ordered items. The ordered items shall remain the property of MISTER BATTERY until they have been paid for in full. If a product should be unavailable at the time of ordering on account of our suppliers, the customer shall be informed about this as soon as possible and be given the option to cancel their order and receive a refund of the amount paid corresponding to the unavailable product or a replacement with an equivalent product. The order shall be dispatched as soon as all the items are available. MISTER BATTERY reserves the right to alter the range of products, their prices and their availability times, according to the constraints imposed by the manufacturers and/or suppliers. MISTER BATTERY shall be required to inform the consumer accordingly.
RETURNING A PRODUCT
As stated under Belgian law, the customer has a right to cancel within 14 calendar days of receiving their order.
Returns are at the expense and responsibility of the buyer. The item must be unused, undamaged and in its original packaging. The parcel containing the item must be correctly packaged so as to protect the item. Transportation is the responsibility of the buyer. We recommend a transportation system that includes tracking. A copy of the purchase invoice must be sent with the item to identify the transaction.
Items shall be tested once they have been returned. The return shall be approved if the item received is no different from its original condition.
As a rule, unsealed batteries are not taken back, but each request shall be examined individually. Please contact us before sending back these items.

Refunds shall be made using the same payment method as the one used for your order. If you paid by Bancontact or bank transfer, remember to provide your full bank details so that we can refund you.
PAYMENT METHODS:
The following payment methods are available to the buyer when submitting their order: Paypal, Maestro, Bancontact, MasterCard, Visa and Home Banking via the HiPay secure gateway. Any order submitted on the site must be paid for within 24 hours of placing it, otherwise it will be automatically cancelled.
DELIVERY:
Items are delivered by the carrier to the delivery address indicated by the buyer when placing their order. MISTER BATTERY undertakes to make every effort to deliver the order as soon as possible after it receives payment for the purchase order. The delivery times indicated on the site or the purchase order are only provided for guidance purposes, and any delays shall not entitle the buyer to cancel the sale, refuse the goods or claim any compensation whatsoever. Any claim for non-compliance or missing goods must be sent within 7 days of the date on which the buyer received the order. MISTER BATTERY shall be relieved of its obligation to deliver in any event of unforeseeable circumstances or force majeure. For guidance purposes, total or partial strikes, flooding and fires are force majeure events. MISTER BATTERY reserves the right to split deliveries, with delivery charges only being invoiced once. If the parcel arrives open and/or damaged and delivery is accepted, the buyer must have the delivery person draw up an anomaly report. If delivery of these goods should be refused, the buyer should ask the carrier to return this parcel to MISTER BATTERY, together with a declaration of fraud and malice and keep a copy of this form, where necessary.
WARRANTY:
Any claim for non-compliance or missing goods must be sent to MISTER BATTERY within 7 days of the date of receipt.
MISTER BATTERY is not liable for misuse, for damage as a result of mishandling, falling, theft, fire, immersion, freezing, defective maintenance or improper storage, or for the normal wear of the parts.
MISTER BATTERY’s liability is limited to the amount of the buyer’s order. MISTER BATTERY cannot be held liable for any tangible or intangible damage or bodily injury caused by the malfunction or misuse of an item purchased on the site.
MISTER BATTERY shall not exchange or reimburse a purchase on the grounds that: the customer changed their mind, regretted their purchase or any other personal or business grounds.
LOST PARCEL:
If the buyer has still not received their parcel, a delivery notification or specific online tracking information regarding their parcel within 10 working days of their order being dispatched, they should contact the carrier quoting the parcel tracking number found in the e-mail informing them that the parcel has been handed over to the carrier.
If the carrier finds no trace of the parcel, the buyer should contact the Customer Service Department of MISTER BATTERY as soon as possible at the following address: info@mister-battery.be
The Customer Service Department shall then open an investigation with the carrier. The buyer shall receive an e-mail informing them that an investigation has been opened and that the response time is between 10 and 30 days from the investigation being opened. If the parcel is located, it shall be forwarded to the buyer immediately. If the parcel is considered lost, MISTER BATTERY shall refund the total amount of the order.
DISPUTES:
Any order placed implies the buyer’s unrestricted acceptance of MISTER BATTERY’s General Terms of Sale. Any dispute relating to the sale shall be subject to Belgian law before Brussels Commercial Court.
